Defense of Educators in Public School Districts

Step 1: Report of Misconduct is Made

• Typically placed on paid administrative leave

• District conducts investigation by interviewing witnesses and collecting evidence

Step 2: Fact-Finding Interview

• Investigator will request an interview of teacher or administrator

• Entitled to attorney/representation, but representation typically cannot talk during this stage

Step 3: Loudermill Hearing

  • A formal pre-disciplinary letter should be sent to teacher or administrator explaining potential discipline

  • Entitled to active participation of attorney/representation

    Step 4: Discipline or Termination

  • Discipline imposed or Notice of Intent to Terminate sent

    • Potential for negotiation

    • Demand for hearing must be timely sent

    Step 5: Termination Hearing

  • Hearing to BOE or to hearing officer

  • Entitled to active particpation of attorney/representation

  • If terminated, right to appeal to Court of Common Pleas
