Welcome (or not) to the terrible world of Title IX and sexual misconduct proceedings. Whether you are a complainant or a respondent, navigating the process of school complaints, investigations, and hearings as well as ancillary proceedings or unintended consequences is rough. We are experienced advocates, advisors, and attorneys here to help you with k12 and college sexual assault administrative proceedings, as well as concurrent matters such as involvement by law enforcement, civil protection orders, or civil lawsuits. 

It is important to first understand whether an attorney is the right fit for the student involved. The student will be sharing often embarrassing and intimate details of situations that are uncomfortable to discuss, and a strong relationship between attorney and client can make a difference in outcome and expectations in a case. 

It is equally important to understand exactly what process the student is involved in. Is it a Title IX case? Does the school have proper jurisdiction? Is it a non-title IX case, handled under perhaps the general code of conduct or in reality, the same process as a Title IX case would involve? Is there a risk of criminal charges, which should alter the strategy employed by an education law attorney? Can you leverage a civil protection case filing for subpoena or deposition power, to obtain often withheld information or evidence to use back in the school proceeding? Does it make sense to negotiate an informal resolution, effect a transfer to another school, or hire experts to use? A student’s reputation, financial success, career path, and in some cases, liberty, is at stake.
